
The new year started with a floodgate of updates on the immigration front from the Home Office.
The Afghan resettlement scheme continued to be of relevance, as the Home Office made relevant updates to concessions to the Rules for Afghan nationals, for work and study routes and other relevant provisions to assist their settlement under family route.
The Business Immigration routes were perhaps the highlight of the month as the Home Office’s list of UK registered companies being granted Sponsor Licence reached a record high! The ripple effect of this reflected in the Guidance on Sponsor Licence and further updates to Policy Guidance for foreign workers under Seasons workers, Skilled workers and Care workers (which by the way are now added on the Shortage Occupation list) routes.
Good news for those under Start up route they would be allowed further extension of leave to remain due to Covid concessions.
Under the case laws, Akinsanya [2022] EWCA Civ 37 SSHD bagged the spot light as the determination concluded such cases must reconsider treatment of Zambrano rights under Appendix EU
On a separate note, the underlying legal principles in relation to Missing the deadline for EUSS applications has been provided by the Home Office in the form of guidance on fresh applications.
