Mastering Immigration Law Subscription Updates September & October 2022

Updates to UK immigration across all spectrums continued to unfold during September and October.

The requirement to provide BRP for both entry clearance and leave to remain applications, have been a mandatory requirement for processing the case with the UKVI for many years. However, the case of KA & Ors [2022] proved as a disruptor to this requirement when considering the circumstances of Appellants. Who were Afghan nationals in hiding and could not have visited the entry clearance post to submit their BRP, as this would have risked their lives. Holding their circumstances exceptional, the Admin Court decided that the requirement for BRP can be waived.

Immigration staff guidance in considering suitability of Deportation and Exclusion from the UK was revised.  The updated Guidance stated strong assertions that an application for entry clearance or leave to remain must be refused on SSHD’s personal direction of exclusion, if the applicant is subject to an exclusion order or to a deportation order or decision to make one.

Updates to requirements for expert cultural organisations and media recognition in Global Talent have been madeTherefore, under the media recognition for instance, if an Applicant is showing exceptional talent, there must be evidence from at least 2 countries of 2 or more examples of significant media recognition. If showing exceptional promise, evidence can be made from just one country. Architecture applicants must show media recognition of their individual work; general arts and culture applicants may also show recognition, as a named member of a group. For exceptional promise applicants under both arts and culture and architecture it is enough to show recognition as a ‘contributor’ to work.

Work visas, Appendix Skilled Occupations adjusted for SOC codes for Global Mobility & Scale-Up. This may be found under Table 1 of the eligible occupation codes and going rates for Skilled Worker (SW), Global Business Mobility (GBM), Global Business Mobility – Graduate Trainee (GTR) and Scale-up (SCU) routes.

Debates relating to Deportation of asylum seekers remained on the forefront along side revisions to the deportation policies.  On 25 August 2022, the Home Office announced plans to fast-track the removal of Albanian nationals “with no right to be in the UK”.  However, in September 2022 following a case law decision, the Home Office can no longer fast track deportations of asylum seekers. The fast track route is only applicable if someone has arrived in the UK and they have not claim asylum.

Celik [2022] UKUT 220 (IAC) the Upper Tribunal considered the rights of partners of EEA nationals who were unable to marry before the specified date, but also established that the right of appeal is sometimes available on human rights grounds against an EUSSch refusal.
